Vietnam Updates Regulations on Oil Spill Response

On 24 Mar 2021, the Prime Minister of Viet Nam issued Decision No. 12/2021/QD-TTg on the promulgation of regulations on oil spill response; this will take effect on May 10, 2021, replacing Decision No. 02/2013/QD-TTG, as amended by Decision No. 63/2014/QD-TTg.


Notable changes include: 

1) Introduction of templates for oil spill response (OSR) plans, to support localities to formulate and prepare their own plans; 

2) Introduction of target durations for the evaluation and approval of OSR plans at all levels; 

3) Requirement for owners of Vietnamese and foreign-flagged seagoing vessels carrying more than 2,000 tons of raw material to have a certificate of insurance or financial guarantee,  in accordance with provisions under CLC 92; and

4) Requirement for Vietnamese seagoing vessels with a total tonnage of more than 1,000 GT operating on international routes to have a certificate of insurance or financial guarantee, in accordance with the provisions of the BUNKER Convention.
