The 1992 Fund is liable to pay compensation as claims arising from the incident exceed the 1992 CLC limit applicable; however, all payments are recovered from the shipowner’s insurer, the Shipowner’s Club, under the Small Tanker Oil Pollution Indemnification Agreement (STOPIA) 2006. The successful cooperation between the Club and the IOPC Funds is extremely beneficial in administering the agreements and regime efficiently.
The total compensation payable for the Hebei Spirit incident under the 1992 Conventions (SDR 203 million) was fixed by the 1992 Fund’s Executive Committee in March 2008 at KRW 321.6 billion. The 1992 Civil Liability Convention limitation amount (SDR 89.77 million) was fixed by the Limitation Court at KRW 139.4 billion in November 2018.

The workshop, held on 23 Jan, was organised by the Malaysian Maritime Enforcement Agency, in cooperation with the Japan Coast Guard, through the Japan International Cooperation Agency, JICA (unofficial translation provided by 'google').
The meeting, chaired by the Department of Environment, Malaysia, was held on 29 Jan, and attended by representatives from government and private agencies involved in wildlife management under the National Contingency Plan (unofficial translation provided by 'google').
Held from 3 to 5 Feb 2020, the workshop prepared the Oil Spill Response Team of the Marine Department to mitigate oil pollution in the waters of Selangor, Negeri Sembilan and Malacca.
The plan serves to tackle several oil spill possibilities, such as spills from oil tankers, spills due to broken pipelines and spills at oil refinery factory, among others.

A national workshop in Ho Chi Minh City, Viet Nam (26-29 November), brought together 40 participants from 10 government entities, and the oil and gas and shipping industry to to further develop Viet Nam’s national oil spill contingency plan. ITOPF 2018 Tanker Oil spill statistics were published on 10 January 2019. The number of oil spills involving tankers remains low with three spills of over 700 tonnes, and three medium spills (7–700 tonnes) reported in 2018.

The Ministry of Natural Resources and Environment (MoNRE) has issued a circular to regulate marine oil spill cleanup and recovery efforts.
Under the circular, an initial and preliminary investigation and assessment on the level of pollution will be made within the first 10 days after an oil spill is reported. If the investigation shows the level of oil in the water is higher than national standards, a more detailed assessment on environmental damage will be completed within 20 days after the preliminary investigation results. The detailed assessment result will be used to classify the oil spill’s impact on the environment.

Director General of Sea Transportation recently organised a Forum on National Command and Control Center for Emergency Relief Operations and Marine Oil Spill in Jakarta on 12th December 2018.
The Forum aims to exchange information from various agencies under the National Team (PUSKODALNAS) to support the implementation of a coordinated system for managing oil spill emergencies in the country.

The National Contact Points of the Gulf of Thailand Cooperation on Partnerships in Oil Spill Preparedness and Response has agreed for the finalisation of the Sub-regional Oil Spill Contingency Plan for the Gulf of Thailand and adoption scheduled in November 2019.
The Regional Oil Spill Contingency Plan (ROSCP), developed under the Memorandum of Understanding on ASEAN Cooperation Mechanism for Joint Oil Spill Preparedness and Response, 2014 (ASEAN MOU) was formally adopted in the 24th ASEAN Transport Ministers (ATM) Meeting on 8 November 2018 in Bangkok, Thailand.

The Indonesian government, through the Directorate General of Sea Transportation, and the Australian Government, through the Australian Maritime Safety Authority (AMSA), signed a Memorandum of Understanding on Transboundary Marine Pollution Preparedness and Response.
Indonesia and Australia have discussed this MoU since 2016 to develop a stronger understanding, between the two countries, in the fields of preparedness, prevention, response and mitigation to combat marine pollution. It will replace the 1996 MoU between the two countries concerning Prevention and Control of Oil Pollution.
Practical oil spill response exercise 2018 was held in Tg. Balau beach, Kota Tinggi, Johor, Malaysia. The exercise was attended by officers from the Marine Department Malaysia, Department of Environment, Department of Marine Parks of Malaysia, Johor Port Authority and Malaysia Civil Defence Force.

IMO recently conducted an intensive 5-day workshop for lawyers and legislative drafters to support the drafting of domestic implementing legislation of IMO treaties. It provides the participants with the tools they need to understand IMO treaties and how they are developed and adopted. On February 28th, GISEA bids farewell to Mr Joselito Guevarra, our long serving project manager. Mr Joselito is a well known figure in the region who has worked tirelessly on the GI SEA program since the program started in 2013. His work has supported many countries on the national, sub-regional and regional levels for various oil spill preparedness and response activities.
Mr Joselito is succeeded by Ms Amanda Chee who will assume the GISEA Project Manager's role. Ms Amanda joins GISEA from Oil Spill Response Ltd (OSRL) and brings with her a wealth of experience in oil spill preparedness projects and oil spill response experiences in Asia Pacific region. Ms Amanda will continue the good works of Mr Joselito to support ASEAN countries in improving their national capacities on oil spill preparedness and response.
In 2018, IMO celebrates 70 years since the Convention establishing the Organization was adopted.

According to IMO website, Myanmar recently acceded to treaty covering on The International Convention on Civil Liability for Bunker Oil Pollution Damage (BUNKER) which applies to damage caused on the territory, including the territorial sea, and in exclusive economic zones of States under the Convention.
H.E. Mr. Kyaw Zwar Minn, Ambassador of Myanmar to the United Kingdom, met IMO Secretary-General Kitack Lim at IMO Headquarters, London to deposit the instrument of accession (19 January). Myanmar’s ratification brings the number of States to accede to the treaty to 87, representing 92.5% of the world's merchant fleet tonnage.

IPIECA has released a new publication - Dispersant storage, maintenance, transport and testing. This was produced in support of the IPIECA-IOGP guidance on surface and subsurface dispersant. Dispersant use can mitigate the overall impact of an oil spill by removing oil from the sea’s surface, thereby protecting marine mammals, birds, coastal habitats and shorelines. The Viet Nam National Southern Southern Oil Spill Response Centre or NASOS will play host to the Subregional Workshop on Developing the Subregional Contingency Plan and Guidelines in the Use of Dispersants in the Gulf of Thailand (GOT). It will be held back-to-back with the 11th Annual National Contact Points (NCP) Meeting of the three littoral states - Cambodia, Thailand and Vietnam - bordering the GOT.
The Myanmar National Task Force (NTF) on the development of the National Oil Spill Contingency Plan (NOSCP) continues in the office of the DMA (Department of Marine Administration) till 2018.

IPIECA, IMO and GISEA attended the largest oil spill conference of the year: the 2017 International Oil Spill Conference (IOSC) and Exhibition.
The 21st MARPOLEX exercise will be held from May 15 to 17, 2017 in Bali, Indonesia. The exercise is a commitment of the Philippines, Indonesia and Japan in the implementation of the ASEAN Oil Spill Response Action Plan and the Sulawesi Oil Spill Network Response Plan.

IMO and IPIECA have jointly launched a new Global Initiative (GI) programme aimed at improving the oil spill preparedness and response capabilities in south east Asia, at a regional workshop that took place from 20 to 21 March 2013 in Jakarta, Indonesia. The workshop and launch event was attended by more than 70 high-level representatives from Government and the maritime, oil and gas industry from countries across the south east Asia region.
